Making a Will

Consultation Response: Wedlake Bell LLP

On 13 July 2017, the Law Commission launched a major consultation project on the law of Wills. The law in this area has not been substantively reviewed since 1837 leading to calls for the law to be modernised to reflect changes in society, technology and medical understanding. The consultation project undertakes a review of a wide range of legal issues relating to Will-making including the test of mental capacity for making a Will, the formalities required to make a valid Will, and whether it should be possible to make an electronic Will as opposed to one on paper. Wedlake Bell’s Private Client team have responded to the consultation to put forward their views on the various issues that affect their clients, and a link to their response document is below. For further information on the consultation or Wedlake Bell’s response, please contact Ann Stanyer or Sally Spicer.
