Wedlake Bell are proud to have represented ACS and DACS in their claim against Ivor Braka Limited which has successfully settled. See below for further details.
The Artists’ Collecting Society (ACS), the Design and Artists Copyright Society (DACS) and Ivor Braka Limited are delighted to announce that they have reached a settlement following a legal dispute over compliance with the UK Artist’s Resale Right legislation. ACS, DACS and Ivor Braka Limited look forward to working together to provide artists with the royalties to which they are entitled. Artist’s Resale Right (ARR) royalties provide essential income to artists, enabling them to create new work and to provide essential support to the entire art world eco-system. The royalty overwhelmingly benefit artists selling work at lower prices, with over 50% of eligible sales falling under £5,000. Since its introduction in 2006, an estimated £140m in ARR royalties have been distributed to artists and artists’ estates in the UK providing a direct contribution to the livelihoods and practice of artists.
