The Building Safety Act 2022 is the biggest reform of building safety regulation in UK history and received Royal Assent on 28 April 2022. The majority of provisions of Building Safety Act will come into force in next 12-18 months.
The Act introduces the Building Safety Regulator and will increase regulation for development of “higher risk buildings”. Existing “higher risk buildings” will also have more regulation and will need to be registered. The Act introduces significant new powers to require parties to address historic building safety defects and new wide reaching powers to prohibit certain persons from carrying out development or applying to building control.
There are also amendments to the Defective Premises Act and Section 38 of the Building Act which will be in force from 28 June 2022, widening the scope for claims against the real estate and construction industry.
