Ann Stanyer’s article on the Law Commission’s consultation on the use of electronic signatures in legal documents has been published in Professional Adviser and its sister publication Retirement Planner.
Ann examines the Law Commission’s proposal that electronic signatures can generally be valid in legal documents without the need for further legislation and asks whether this should be the case for legal documents such as Lasting Powers of Attorney which are often signed by elderly and/ or vulnerable people.
The Law Commission’s Consultation Paper Electronic Execution of Documents issued on 21 August 2018 is looking into the legal requirements for signing, witnessing and delivery of documents by both commercial parties and consumers.
