Family Partner quoted on recent Family Court decision
The Family Court has recently dismissed an application by a so-called “serial sperm donor” to be declared the legal parent of a child conceived outside a UK licensed fertility clinic.
The judgment highlights the significant legal, emotional and safeguarding risks that can arise where conception takes place through unregulated arrangements, and the importance of understanding how family law and wider protections apply in modern family structures.
Commenting on the decision, Family & Divorce Partner and Chair of Resolution’s Domestic Abuse Committee, Rebecca Christie has said:
“This case provides a powerful judgement for those considering conceiving using unregulated sperm donations outside of a UK licenced fertility clinic. This case highlights, that in a world where we have undergone a period of significant change in how families are created and structured, as practitioners we need to be alive to how different forms of domestic abuse could be perpetrated, including through unregulated sperm donation. It was highlighted in this case that whilst the behaviour of Mr Albon was “not criminal” [para 57], “there was no indication that Mr Albon’s behaviour is governed by any recognised moral principles” [para 83].”
