Head of IP & Commercial quoted in WIPR on Shein v Temu copyright ruling
Head of Wedlake Bell’s IP & Commercial team, Michael Gardner, has been quoted in a recent World Intellectual Property Review (WIPR) article examining the High Court’s decision to dismiss Shein’s copyright infringement claims against rival fast-fashion platform Temu.
The article explores the implications of the High Court judgment, which rejected Shein’s claims concerning thousands of product photographs and found that Temu had not authorised copyright infringement by third-party merchants. The ruling also raises important questions around platform liability, copyright ownership and the risks associated with large-scale takedown campaigns.
Commenting on the decision, Michael describes the outcome as “a blow to Shein” and notes that the judgment is “a favourable ruling from the point of view of websites” that operate as marketplaces for third-party sellers. He also suggests that Shein may seek to appeal the ruling, given the significant copyright law issues considered by the court.
