Tim Maxwell, Head of Art & Luxury, and Matthew Shore, Associate Barrister in the Art & Luxury team, have been quoted in a recent Antiques Trade Gazette article examining the UK regulator’s continued scrutiny of applications for exemptions under the Ivory Act 2018.
The article explores new information obtained through a Freedom of Information request, which suggests that the Animal and Plant Health Agency (APHA) is maintaining a robust approach when assessing applications for ivory exemption certificates.
Tim and Matthew, who have advised on a number of cases involving the Ivory Act, comment on the practical implications for collectors, dealers and owners of ivory-containing objects. They note that the legislation has shifted the focus towards satisfying tightly drawn statutory exemptions, meaning that applicants must present thorough and well-supported evidence, including provenance research, condition reports and expert opinions where appropriate.
