Employment Partner William Granger has been quoted in a recent The Law Society Gazette article discussing a landmark Supreme Court judgment on discrimination protection for part-time workers.
The article reports on the Supreme Court’s decision in Augustine v Data Cars Limited, which considered the rights of part-time workers under the Part-Time Workers (Prevention of Less Favourable Treatment) Regulations 2000. The Court ruled that a worker’s part-time status can be an effective cause of less favourable treatment and does not need to be the sole cause.
Commenting on the judgment, William explains that the decision provides part-time workers with greater discrimination protection and lowers the threshold for establishing less favourable treatment claims. He notes that the ruling removes an anomaly whereby part-time workers previously enjoyed less protection than workers protected under other discrimination legislation.
