Our Property Litigation team is a specialist practice focusing exclusively on contentious property matters. As part of one of London’s largest real estate departments, we act on complex and high-value disputes across a broad client base, including investors, developers, occupiers, receivers and insolvency practitioners.
We work closely with our transactional colleagues to anticipate and resolve issues early to minimise the risk of disputes wherever possible. When litigation becomes necessary, we ensure our clients are positioned to secure the best possible outcome. We understand that litigation is often a last resort. Our approach is flexible, commercial and outcome-focused. We guide clients through the most appropriate route to resolution, whether via court or tribunal proceedings, arbitration, expert determination, mediation or negotiated settlement.

Our services include:
Development work: We advise on all aspects of development property work including easements (rights of way, rights of light and other forms of easement), boundary disputes, restrictive covenants and party wall matters.
Overage and deferred payments: We handle disputes over triggered payments tied to planning, development or sale milestones.
Forfeiture and possession: We act on possession claims and in forfeiture proceedings, supporting landlords in regaining control of their premises and advising tenants on defending claims or negotiating re-entry.
1954 Act lease renewals: We guide clients through business lease renewals, both opposed and unopposed, under the Landlord and Tenant Act 1954.
Tenant default and insolvency: We deal with arrears and lease liabilities during insolvency, acting for landlords, tenants and insolvency practitioners.
Break options: We advise on serving and responding to break notices, ensuring compliance with notice and condition requirements.
Service charge disputes: We act in disputes over reasonableness and recovery of service charges, often in complex or mixed-use properties.
Leasehold enfranchisement: We advise landlords and tenants on extending leases and acquiring freeholds, including high-value and contested claims.
