Lizzie Whelan

Lizzie is a solicitor in the Commercial Disputes team.

She advises both UK-based and international clients on commercial disputes and litigation across a wide range of commercial disciplines.

She deals with a broad range of work, including disputes relating to contracts, insurance, insolvency, companies, shareholders, partnerships, finance and banking, pensions, IT, professional negligence, professional regulation and civil fraud.

Lizzie is also regularly involved in contentious insolvency matters, such as advising banks and insolvency practitioners on the validity of their security and enforcement options and advising in relation to recovery procedures for lenders, including guarantee-related security enforcement. She assists clients in resolving their disputes through negotiation, litigation, arbitration and mediation, often in combination and alongside other methods of alternative dispute resolution.

She is frequently involved in general commercial litigation in the High Court and County Court.

• Advising a client and issuing High Court proceedings in respect of a title and potential fraud claim concerning a Francis Bacon artwork, where the defendant fraudulently obtained monies and asserted ownership over the painting.
• Acting for several contemporary artists, collectors and other agents/galleries in claiming artworks and/or monies due as part of an art gallery’s administration and advising on options for the recovery of assets, including potential claims against the gallery and its former directors.
• Advising a client on a Covid-19 business interruption claim against its insurers.
• Pursuing High Court proceedings against a company for failure to pay minimum royalties due to our client under an exclusive licence agreement.
• Acting for liquidating trustees in respect of a potential claim against a company for legal services provided, including pursuing insurers under professional indemnity and investment management insurance policies.
