Expertise 
Kirk is an associates in the Commercial Litigation and Insolvency and Business Recovery departments and is instructed by a diverse array of clients ranging from insolvency practitioners to companies and private clients. He practises predominantly in contentious matters, both in insolvency and commercial litigation. In insolvency, this includes pursuing antecedent transactions, misfeasance, breach of directors’ duties and fraud claims, as well as bankruptcy litigation, including the possession and sale of property and applications for disclosure.
He has experience of interviewing directors, analysing accounts and papers and making various interim applications.
In commercial litigation, Kirk has successfully brought claims in both the county courts and High Court, predominantly acting for claimants.
He has experience in drafting pleadings, witness statements and applications. He is also well versed in alternative dispute resolution, both formal mediation and without prejudice meetings, as well as without prejudice correspondence so as to achieve the best possible out-of-court outcome for clients.
