The ruling overturned an earlier Employment Tribunal decision and found that Next was entitled to pay its warehouse workers more than its shop assistants, accepting that recruitment and retention pressures in the warehouse labour market provided a legitimate business justification for the pay differential.
Stephen commented that the decision will be helpful for other retailers seeking to rely on market forces as a justification for pay differences, but cautioned that employers will still face a heavy evidential burden and that the evidence required will vary depending on the circumstances of each business. He also noted that further clarity from the higher courts would be welcomed in an area of law that has remained uncertain for some time.
