Ann Stanyer comments in Professional Adviser on rise in LPA financial misconduct complaints
Private Client consultant Ann Stanyer has been featured in Professional Adviser, commenting on the record number of complaints relating to alleged financial misconduct by attorneys acting under Lasting Powers of Attorney (LPAs).
Ann discussed the factors that may be contributing to the increase in concerns raised with the Office of the Public Guardian (OPG), noting that greater awareness of how LPAs operate and how concerns can be reported is encouraging friends and family members to be more proactive in raising issues.
She also emphasised the importance of putting robust safeguards in place when drafting LPAs, highlighting the need for advisers to carefully consider an attorney’s skills, financial management capabilities, available time and understanding of the donor’s needs and personal circumstances.
