About Kelly
Expertise 
Kelly is a solicitor with extensive experience handling a wide range of real estate matters, including asset management, leasing and development work. Currently, she focuses on projects and infrastructure assets, with a particular focus on the ports industry. Her work frequently involves providing advice on commercial contracts, planning, environmental and development issues related to these sectors.
Kelly also has many years of experience handling all aspects of conveyancing and has advised clients on a broad range of real estate related matters, including property transfers, title issues, regulatory compliance and disputes.
In addition to her UK qualification, Kelly is admitted as an attorney, notary public and conveyancer of the High Court of South Africa.
Experience 
- Acting regularly for a major UK port in relation to real estate development and management matters arising in respect of its approximately 2,500 acre estate. This work often includes drafting, negotiating and completing leases (both long and short-term leases), deeds of variations and surrenders, as well as licences for alterations, licences to underlet and licences to assign.
- Advising a landowner on the revocation of an existing at-grade crossing and replacement with a lease for a bridge over a railway, including asset protection of the railway during construction and ongoing issues around use and alienation.
- Advising a landlord in connection with a tenant’s application for consent to works to upgrade its power supply, including the surrender of part of the tenant’s demise, grant of a substation lease and associated easements between an adjoining landowner, tenant, Distribution Network Operator and Independent Distribution Network Operator.
- Advising a landlord on solar panel installations, including considerations around the sale and export of generated power back to the grid, how and if the landlord may capitalise on the arrangement and the division of power use across different lease demises.
- Acting for private banks and lenders on drafting and registering securities, including mortgage bonds and general and special notarial bonds and securing additional security through suretyships, guarantees and shortfall undertakings.
- Acting for sellers and buyers in the acquisition and disposal of commercial and residential properties, including the transfer of a commercial property sold at public auction for ZAR100 million on behalf of a private bank.
