Wedlake Bell Family Team

Wedlake Bell’s Family Team were instrumental in obtaining clarification from the Supreme Court on 23 May 2016 in the case of In the matter of Re D (a child).

The decision of the Supreme Court has clarified the law in relation the jurisdiction of the Supreme Court to hear appeals relating to the recognition and enforcement of EU judgments under the Brussels II Revised Regulation, that is judgements relating to matrimonial matters and matters of parental responsibility for children. The Supreme Court has held that the effect of EU law (Articles 34 and 68 of the Brussels II Revised Regulation) is that it does not have jurisdiction to hear appeals concerning these matters. This effectively means that the Court of Appeal is the final appellate court in this country.
